Candar Beta Terms of Use
1. About these Terms
These Terms of Use govern your access to and use of Candar, including the Candar mobile application, website, beta services, messaging, discovery, profile, location and related features.
By creating an account, accessing the beta, or continuing to use Candar, you agree to these Terms. If you do not agree with these Terms, you should not use Candar.
Candar is currently a beta service. Features may be incomplete, changed, removed, unavailable or temporarily unreliable while testing and development continue.
2. Adults Only
Candar is intended only for adults aged 18 years or older.
You must not create or use a Candar account if you are under 18, and you must not falsely state or misrepresent your age in order to access Candar.
Candar may take reasonable steps to enforce its adult-only requirement where required for safety, legal compliance or operation of the service.
3. Beta Testing
By participating in the Candar beta, you understand that the service is still under development.
You may encounter bugs, interrupted service, incomplete functions, inaccurate information, lost settings, failed notifications or other technical problems.
Beta features, membership levels, limits, prices and functionality may change before public release. Participation in the beta does not guarantee continued access to Candar or to any particular feature after the beta period ends.
We may update, suspend, restart, replace or discontinue parts of the beta where reasonably necessary for testing, security or development.
4. Your Account
You are responsible for activity carried out through your Candar account and should keep your login credentials secure.
Candar is designed to allow users a degree of privacy and personal discretion. You are not required to publicly disclose your real-world identity merely because you use the service, unless disclosure becomes legally required in a particular circumstance.
You must not impersonate another real person, fraudulently represent yourself as another person, or use Candar to deceive another user in a way that causes harm.
5. Profiles and User Content
You remain responsible for the information, photographs, messages and other material that you submit to Candar.
You retain ownership of content that belongs to you. By uploading or submitting content to Candar, you give Candar a limited, non-exclusive licence to store, process, reproduce and display that content only to the extent reasonably necessary to operate, secure, moderate and provide the Candar service.
You must have the legal right to upload any content you submit.
You must not upload unlawful material, material that infringes another person's rights, non-consensual intimate material, material involving minors, content intended to exploit or harm another person, or other content prohibited by law.
Candar may remove content where reasonably necessary to comply with law, platform requirements, safety obligations or these Terms.
6. Conduct Between Members
Candar is intended to help adults communicate and connect by mutual choice.
You must respect another member's decision not to communicate, meet, respond or continue an interaction.
You must not use Candar to harass, threaten, stalk, intimidate, exploit, defraud or deliberately deceive another person.
You must not publish another person's private information without permission, distribute malware, spam, scams or phishing material, or use Candar to arrange or promote illegal activity.
Disagreement, rejection or an unwanted conversation does not by itself establish misconduct. Candar may consider context when reviewing reports.
7. Privacy and User Choice
Privacy and personal choice are important parts of Candar's design.
Candar includes features that allow members to control aspects of their visibility and interaction with other members. These may include Ghost Mode, profile visibility controls, distance controls, Map visibility and other privacy settings.
You are responsible for choosing the privacy settings appropriate for you.
No online service can guarantee complete anonymity or absolute privacy. Other users may take screenshots, record information or recognise another member through information that member chooses to disclose.
Candar's handling of personal information is also governed by its Privacy Policy, which should be read together with these Terms.
8. Location and Map Features
Candar may provide optional location-related features.
Depending on your settings and permissions, Candar may process device location information to provide discovery, proximity, distance or Map functions.
Location information may be approximate, delayed, deliberately privacy-adjusted or otherwise different from a person's precise physical location.
Candar location information must not be relied upon for navigation, emergencies, personal safety decisions or determining another person's exact location.
Members control whether certain Map-related visibility features are enabled, subject to the technical and safety operation of Candar.
Disabling a public Map feature does not necessarily mean that Candar ceases processing all location information required for other enabled discovery functions.
9. Meeting Other Members
Candar provides technology that allows adults to discover and communicate with other adults.
Candar does not investigate, endorse or guarantee the identity, intentions, honesty, background, conduct or compatibility of every member.
You are responsible for deciding whether, when and how to communicate with or meet another person. Users should exercise reasonable care when meeting people they first encounter online.
Candar is not responsible for private arrangements, meetings or transactions made independently between members except where responsibility cannot legally be excluded.
10. Messaging
Messages sent through Candar may be stored and processed as required to provide messaging, moderation, abuse prevention, security and related functionality.
Do not assume that another member has read, received or responded to a message merely because it has been sent successfully.
Features involving message status, deletion, editing, delivery, read indicators or disappearing content may be modified during beta testing.
Users should not rely on Candar messaging as an emergency communications service.
11. Moderation and Reports
Candar may investigate reports of misconduct, safety concerns, abuse or breaches of these Terms.
Where appropriate, Candar may issue a warning, restrict functionality, remove content, temporarily suspend an account or terminate access.
Candar intends, where reasonably practical, to distinguish between genuine mistakes and deliberate or repeated misconduct.
Where circumstances permit, Candar may provide a user with information about a concern and an opportunity to respond before permanent action is taken.
However, immediate restriction or termination may occur where reasonably necessary because of serious safety concerns, illegal activity, exploitation, fraud, significant abuse, threats to the service, legal requirements or similar circumstances.
Candar is not required to disclose confidential reports, security methods, personal information belonging to another user or information that cannot lawfully or safely be disclosed.
12. Blocking and Safety Features
Candar may provide blocking, reporting, privacy and safety tools.
These tools are intended to assist users but cannot guarantee that unwanted contact will never occur.
Attempts to deliberately bypass another member's block, privacy choice or account restriction may constitute a breach of these Terms.
13. Beta Memberships and Features
Candar may test different membership levels, including free and premium-style features.
Features offered during beta may be experimental and may not represent final commercial membership plans.
If Candar later introduces paid subscriptions or purchases, applicable prices, renewal terms and payment conditions will be shown separately before a purchase is made.
Receiving access to a particular beta feature does not create a permanent entitlement to that feature.
14. Intellectual Property
The Candar name, branding, software, interface, graphics, designs, code and other material created by or for Candar remain the property of their respective owners and are protected by applicable intellectual property laws.
These Terms give you permission to use Candar for its intended personal use. They do not transfer ownership of Candar's intellectual property to you.
You must not copy, sell, commercially exploit, reverse engineer, interfere with or reproduce substantial parts of Candar except where permitted by law.
15. Security and Misuse
You must not attempt to gain unauthorised access to Candar, another user's account, Candar's databases, servers or administrative systems.
You must not deliberately probe, attack, overload, disable or interfere with the operation or security of Candar.
If you discover a security vulnerability during the beta, please report it privately to Candar rather than exploiting or publicly disclosing it in a way that creates risk to members.
16. Service Availability
Candar does not guarantee uninterrupted or error-free service.
The service may occasionally be unavailable because of maintenance, upgrades, technical problems, third-party infrastructure, network failures or circumstances outside Candar's reasonable control.
Because Candar is in beta, interruptions and changes may occur more frequently than they would in a mature production service.
17. Account Suspension and Termination
You may stop using Candar at any time.
Candar may suspend or terminate an account where reasonably necessary because of a serious or repeated breach of these Terms, safety concerns, fraud, misuse, legal requirements or threats to Candar or its users.
Where appropriate and reasonably practical, Candar may provide notice before permanent termination. Serious misconduct may result in immediate restriction or termination.
Termination of an account does not prevent Candar from retaining information where retention is reasonably necessary for legal, security, fraud-prevention, dispute-resolution or regulatory purposes.
18. Disclaimer
Candar is provided on an as available and, during beta, as tested basis.
Candar does not guarantee that profiles, statements, photos, locations, messages or information supplied by other users are accurate.
Candar does not guarantee that the service will meet every user's expectations or that every defect will be identified during beta testing.
Nothing in these Terms excludes any guarantee, right or remedy that cannot lawfully be excluded under applicable law.
19. Limitation of Liability
To the maximum extent permitted by law, Candar is not responsible for indirect, incidental, special or consequential loss arising from the use or inability to use the beta service.
Candar is not responsible for the independent conduct of another member merely because that person uses Candar.
Nothing in these Terms limits liability where such liability cannot lawfully be limited or excluded.
20. Changes to These Terms
Candar may update these Terms as the beta develops or where changes are required for legal, operational, security or product reasons.
Where a change is significant, Candar will make reasonable efforts to notify users through the application, website or another appropriate method.
The version and effective date displayed with these Terms identify the terms currently applying to the beta service.
21. Governing Law
These Terms are intended to be governed by the laws of the State of Wyoming, United States of America, without regard to conflict-of-law principles, once the Candar operating entity is established.
Where a user's local law provides mandatory consumer, privacy or other rights that cannot lawfully be excluded by contract, those rights continue to apply.
22. Candar Operator and Contact
Candar is currently in beta. The service is intended to be operated by a Wyoming, USA limited liability company prior to public commercial launch.
